Litigation - Enforcement - Garnishee order
Our client obtained a judgment in their favour and has since obtained a garnishee order for the full amount. The debtor has paid off a portion. Are we required to amend the garnishee order as it is addressed to the debtor's bank for the full amount?
Thank you for the question.
There is no requirement to apply to amend the amount stated in the order, however, the bank should be made aware of the outstanding amount so that no overpayment is made.
