Family Law – COVID-19 – Signing financial agreement remotely

In light of COVID-19, how can a financial agreement be executed with the required advice if it needs to be done remotely rather than face to face?

Thank you for the question.

The financial agreement can be posted to the client, or emailed if the client has printing facilities. A meeting can then be arranged via any audiovisual means during which the practitioner sees the client sign the document. The client then returns the signed agreement either by email or post, following which the practitioner signs as witness to the document as they saw it being signed.

Having given the advice to the client over the phone, the practitioner can then sign the independent legal advice certificate.

This process can then be repeated for the other party.
