Asked

Estates - Minor's trust and tax returns

I am acting for an estate that has a minor’s trust. Do annual tax returns need to be lodged by the trustee for the minor’s trust until the gift has vested in the child?

Answered

Thank you for the question.

Yes, the trustee lodges tax returns for the minor beneficiary and pays tax at normal marginal rates.

For more information see the ATO page Appendix 9: Instructions to trustees where a beneficiary is under 18 years of age – other than trustees of deceased estates.
