Asked

Employment - Monitoring employee emails

Can an employer monitor an employee’s emails and internet usage without providing notice?

Is it generally accepted that email content is the property of the employer?

Answered

Thank you for the question.

Yes. An employee’s emails and internet usage may be monitored without providing notice. It is, however, best practice for employers to have a policy stating that emails and internet usage are monitored and to ensure this is communicated to all employees.

An employer’s workplace computer system – including the content of any emails – is the employer’s property.
