Hi,

This is just a general question in relation to the By Lawyers contract. I have been using the By Lawyers contract for some time now when acting for the vendor. While I am not a high volume practice I am yet to receive a By Lawyers contract when acting for purchasers. My questions are therefore:

Are you satisfied with the take up rate of the By Lawyers contract?

Have any issues emerged and/or litigation occurred around the contract or aspects of it?

Will you continue to support it with updates and availability for the foreseeable future (say the next 5 years)?

One of the benefits of using the By Lawyers Contract for sale of land is that we respond to changes in law and practice immediately rather than by committee review periodically.

Understandably the takeup of its use has been gradual as long established habits of using the law society contract need to be changed. Nevertheless its use continues to grow and those using it are very happy and report that the transactions run smoothly and without the negotiation of special conditions and the need for requisitions as is the norm with the law society contract.

There are some major conveyancing organisations who wish to use it and await the soon to come ability to have them signed electronically through Docusign or similar software.

There have been no issues or litigation arising from its use and it has been gratifying how popular it has proved with users.

The contract as with all our publications will continue for the foreseeable future.
